Tenancy agreement

Just in case you need it, here is an example of the contract you signed with us upon moving in.

By signing this document there is made a legally binding agreement
about renting student accommodation between
Studentsamskipnaden i Trondheim, SiT, as the owner and [!costumernumber] [!name] as the tenant.

This agreement and the subsequent tenancy is administered by SiT Bolig. Conditions not mentioned in the present documents are regulated under Husleieloven (the Landlord and Tenants Act) of 26th March 1999 with subsequent amendments.

Rental period:
This tenancy agreement starts [!contractfrom] and ends [!contracttill], see § 16, last sentence. If your admission lasts longer than [!contracttill], you may have a new contract for next academic year. If you want to end the contract before [!contracttill], you must give one months notice.

Rent:
Please see tariff [!price] price list I, for monthly accommodation price. Please find price list I at www.sit.no/contract_enclosures. The rent is due the 20th every month. The bill will be sent to www.sit.no/yourpage. House rent starts [!contractfrom].

 

Deadline to reply and pay deposit:
If SiT has not received a signed contract 5 days after [!madedate], the offer will be cancelled / null and void. Students living outside Norway must send a receipt that confirms that deposit is paid togheter with the signed contract.

Contract enclosures:

§ 1 WHO CAN BE A TENANT?
1. It is assumed that the accommodation should cover the tenants housing needs during his/her study period.

2. The tenant must have paid the semester fee to SiT, unless otherwise specified. If the terms in points 1 and 2 are no longer met, SiT has the right to terminate this agreement according to § 5 of this contract, or it can annulled (see the Norwegian Tenancy Act § 9-9).

3. The tenant is obliged to inform SiT Bolig if he/she is no longer a student, or if there is a change in family situation which affects his/her right to rent, see the instructions for student housing appendix 1.

§ 2 THE TENANCY AGREEMENT
1. Within 5 days from the date this agreement is made, the tenant must have returned one signed copy of the tenancy agreement. Failing this, the offer will be withdrawn.

2. Before the key to the room/apartment is handed over, an official receipt must be presented to prove that the deposit has been paid. If the key is collected before the contracts starting date, the rent must be paid from the date the key is collected.

3. You are not permitted to let anyone else take over your residence. An exception can be made if subletting has be approved according to § 14.

§ 3 DEPOSIT
1. The deposit is a form of security for the financial responsibilities the tenant has towards SiT Bolig throughout the period of tenancy.

2. The final settlement will be made as soon as possible, and at the very latest within two months after the expiry date of the agreement.

3. The landlord can deduct rent that has not been paid and any other costs that occur from breach of obligations on behalf of the tenant.

4. SiT Bolig claims interest on the deposit in accordance to Husleieloven § 11-2, subsection 4.

§ 4 RENT
1. The current rates for the rent and deposit are listed in attachment 2.

2. The tenant is to pay the rent by the 20th of each month, which is partly in advance. In the month of moving in and/or the month of leaving, the rent is calculated on a daily basis. In the case of late payment, dept collection will be implemented and the extra cost charged to the tenant. The tenant is responsible for the rent from the starting date stated above even if he/she actually moves in at a later date. The tenant is also responsible for the rent during the period of notice of termination even if he/she has already moved out.

3. SiT Bolig can regulate the amount billed to cover the cost of electricity. The regulation will be based on consumption and actual costs. SiT’s collaborating partner on buying electricity is Trondheim Energi. If you choose any other supplier, you will be billed administration costs.

4. If the tenant moves out and hands in the key before the period of notice has expired, and another tenant moves in, the extra rent will be retained by SiT Bolig.

5. The total bill, including charges for additional services, is rounded off to the nearest krone (NOK).

§ 5 GIVING NOTICE/ MOVING OUT
1. The tenant is entitled to terminate the tenancy with one month’s notice, starting from the date SiT Bolig receives the notice. Notice must be given by using the form found at SiT’s web site. SiT has the same right to terminate the contract.

2. When the period of tenancy has expired, the tenant should return the flat/apartment to SiT Bolig with all appliances tidied, cleaned, and in the same condition as when it was taken over, apart from general deterioration as a result of wear and tear. Defects and replacements that the tenant has not put in order can be taken care of by SiT Bolig and the cost charged to the tenant. Belongings left behind, will be thrown away (see the Norwegian Tenancy Act § 10-4).

3. After a tenant has given in his/her notice/moved out, the same student cannot enter into a new tenancy agreement in the same student village until six months after the date of moving out.

§ 6 INTERNET CONNECTION
1. There is an internet connection in the residence (except for Innherredsveien 16, Jakobsliveien 55 and Klostergata 20). When Innherredsveien 16 gets an internet connection the rent will rise by 130 NOK.

2. As a tenant you are responsible for all use of the internet from your room/ apartment. You also have the responsibility if you are giving friends/ visitors access. The tenant must abide NTNU’s IT rules with supplementary regulations which can be found at NTNU’s web sides.

§ 7 HANDING OVER THE ROOM/APARTMENT
1. SiT Bolig is obliged to have the room/apartment at the tenant’s disposal at the agreed time, and in a clean and tidy condition.

2. The tenant should check that both the room and all the equipment according to the check list are in order. Please find the check list at www.sit.no/contract_enclosures. One copy of the check list should be signed and returned to SiT Bolig within 3 days after the key has been handed over. SiT Bolig will keep one copy of the check list as part of the tenancy agreement.

§ 8 THE LANDLORDS RESPONSIBILITIES DURING THE COURSE OF THE TENANCY
1. SiT Bolig is responsible for all indoor and outdoor maintenance of the building and property. SiT Bolig is also responsible for keeping the residence in the same standard as it was when the residence was handed over, except for normal wear and tear.

2. SiT Bolig has the right to inspect the cleaning of the shared kitchen and bathroom at regular intervals. SiT Bolig can improve the cleaning in common kitchens/bathrooms when the improvement requirements, after a given warning, have not been fulfilled. The cost of this will fall on the tenants, see pricelist II.

3. When tenants report defects/ damages to SiT Bolig, the report is seen as permission to enter the residence. During inspection/ improvement SiT Bolig will take the tenants needs in to due care.

4. SiT Bolig can not be held responsible for disadvantages due to repair of unexpected incidents, e.g., a water leak, theft during the contract period see § 10-3 on household contents insurance.

§ 9 BREACH OF THE CONTRACT ON THE PART OF THE LANDLORD
1. A tenant that according to § 2 of the tenancy agreement has accepted the agreement, but is not given the residence to disposition permanently or temporarily from the day the tenancy starts, can request that SiT Bolig provides an alternative residence.

2. The landlord is obligated to improve, without unnecessary delay, defects or damages the tenant has reported when moving in or later.

3. If the defect is due to ongoing maintenance work, or there is another good reason for the defect, the landlord has the right to repair the defect temporarily even if this gives a worse, bit still acceptable, solution for the tenant than that stated in the agreement.

4. If the landlord does not comply with the tenant’s request of improvement, or if the defect is not repaired as stated in point 3, the tenant can end the agreement unless the defect is seen as insignificant.

§ 10 THE TENANT’S RESPONSIBILITIES AND OBLIGATIONS
1. The tenant is required to treat the flat/apartment and the property itself with appropriate respect. The tenant is not responsible for damages or defects caused by general wear and tear.

2. The tenant can not make any changes to the residence or the property in general.

3. The tenant must replace all damages incurred whether they are the fault of the tenant, his/her family, a subtenant or anyone else the tenant has allowed to enter his/her room/apartment.

4. The tenant is obliged to take out household insurance to cover the cost of self-induced water and fire damages.

5. To avoid frost damages, the residency must be kept at a reasonable temperature.

6. The premises may not be used for any other purpose than that specified in the agreement unless agreed with the landlord.

7. If you discover any damage that needs to be repaired, this must, without unnecessary delay, be reported to SiT Bolig. The tenant is obliged to do whatever is necessary to prevent economical loss for the landlord as a result of the damage. Tenants are obliged to report other damages to the property without unnecessary delay. If the tenant is not responsible for the damage, the tenant can request that costs that have occurred, within reason, can be compensated. If the tenant does not comply with this obligation, he/she can be held responsible for the damages resulting from the delay.

§ 11 BREACH OF CONTRACT ON THE PART OF THE TENANT
1. The tenant accepts Norwegian law which determines that he/she can be forced to leave the rented premises if the rent and/or charges for additional services are not paid within 14 days after a written request has been presented or 14 days after the normal due date for paying the rent. According to The Norwegian Enforcement Act § 13-2, subsection 3 litra a, the landlord can may request dispossession without a law suit. If the tenant fails to vacate the residence when the tenancy is over, the tenant will be evicted without a law suit see § 13-2, subsection 3 litra b or c of The Norwegian Enforcement Act.

2. If the contract is breached in any other considerable way by the tenant, the tenancy agreement can be annulled, see the Norwegian Tenancy Act § 9-9.

Material breach of the contract can be:

a) The tenant considerably fails to oblige to pay rent or to pay other demands that arise from the agreement.

b) The tenant, without permission, allows a third party to use the residence, and does not stop the situation even after a written warning from the landlord.

c) The tenant, without permission, uses the residence in any other way then what is intended and agreed, and does not stop the situation even after a written warning from the landlord, or

d) The tenant fails to oblige to his/her responsibilities in a way that makes it necessary to terminate the tenancy agreement.

If the tenant in these circumstances does not voluntarily move out of the residence, the tenant can be evicted, see tvangsfullbyrdelsesloven § 13-2, 3. point, part d.

3. If the keys are not handed in ans you have not moved out by the end of the contract, you will be charged 500 NOK each day in addition to normal rent. This to cover our extra costs due to the breach of the contract. The tenant is also responsible for any costs that come from eviction, law suits and clearing out.

§ 12 NON SMOKING AREA
1. Smoking is not permitted in any SiT Bolig building. This applies both to private and shared areas and balconies. Costs due to breach of this paragraph will be charged.

§ 13 PETS / DOMESTIC ANIMALS
1. Keeping pets or domestic animals is not permitted in any SiT Bolig accommodation. Exception is made for guide dogs.

§ 14 SUBLETTING
1. Subletting must be approved by SiT Bolig.

2. Subtenant must be a student. The subtenant must be made aware of the contents of this tenancy agreement.

3. During the period of subletting the tenant is responsible for making sure that rent and any additional charge is paid on time. The tenant is also responsible for any damage to the room/apartment, the inventory or the property in general.

4. The Norwegian Tenancy Act § 11-2 gives student associations more rights to deny subletting than other landlords.

§ 15 SiT CAN REQUIRE MOVING DURING RESIDENCY
1. If extensive renovation/rehabilitation work is being carried out, the tenant may be obliged to move to another flat.

2. If you live in an apartment adjusted for handicapped students (see "Information about the residental unit"), we may end this contract and offer you another student apartment. SiT decides which student that should be offered our adjusted apartments.

§ 16 TRANSFERRING
1. If you would like to move from one SiT accommodation to another, a new tenancy agreement must be signed. All financial matters from the previous agreement must be settled before the transfer.

§ 17 LIVE-IN PARTNER AND CHILDREN
1. According to the fire instructions, we must have a summary of all residents. Any changes in your household must be registered at sit.no/yourpage.

§ 18 JURISDICTION
1. We agree that any disputes arising from this agreement shall be solved by the appropriate legal authorities located in Trondheim.

§ 19 GOVERNING LAW ECT.
1. This agreement shall be governed by and interpreted according to Norwegian law.

2. The Norwegian Tenancy Act will apply. This agreement shall, however, prevail in case of conflict between the provisions hereof and the non-mandatory provisions of the Tenancy Act.

3. This agreement is valid for renting housing that is to be used by people with specific housing needs temporarily, see The Norwegian Tenancy Act § 11-2.

4. The rules in The Norwegian Tenancy Act § 11-2 gives the tenant less rights than when renting other types of housing. § 11-2 gives the tenant less rights concerning the minimum time for a time restricted contract, admission to housing, subletting, and interest from the deposit and advanced rent payment. Unless otherwise stated, the Norwegian Tenancy Act from 26.03.1999 no. 17 will be applied to the tenancy agreement.

§ 20 SIGNATURES
We agree that any disputes which may have to do with this tenancy agreement, shall be solved by the appropriate legal authorities located in Trondheim.
